Terms and conditions
ALL4BAND DESIGN is a design studio run by Vladyslav Tsarenko, registered sole entrepreneur under the registration number 14115166 in Prague, Czech Republic, at the address Chlebovicka 493, in cooperation with the company Virtual Pulse s.r.o, registration number 28513185, residing at the address Chlebovicka 493, Prague, Czech Republic. Other members of the design team work as sub-contractors. However, all responsibility for the quality of the services provided is held by Vladyslav Tsarenko, CEO of the studio.
QUOTATIONS AND PROJECT ACCEPTANCE
We generate an obligation-free quotation on the basis of the client's brief received by email or any other type of written communication (including Instagram Direct and Facebook Messenger). The client's acknowledging acceptance of the quotation binds the client to accept the current terms and conditions.
RIGHTS OF REFUSAL
We reserve the right to refuse a project without giving a reason. This mostly applies to projects that are, in our opinion, immoral, offensive, obscene, or illegal. We can also refuse a project if we feel that we're not able to implement it in a way that it can meet the client's expectations.
DESIGN PROJECT DURATION
We do our best to meet the estimated duration, but no quoted artwork delivery dates are guaranteed and can vary. Any indication of a design project’s duration is to be considered by the customer to be an estimation. If you have a strict deadline, please, inform us in advance and we will do our best to meet it.
DESIGN CHARGES AND PAYMENT TERMS
Charges for design services provided by our team will be set out in the written estimate or quotation that is provided in reply to the client’s brief. No additional charges will be applied to the project unless the client changes the initial design brief or requires more drafts or revision rounds than included in the standard package. After accepting the quotation for the project, the client sends a non-refundable payment of 50% of the quoted fee. The second payment is sent after the client’s approval of the final preview of the finished design. After receiving the second payment, we provide the client with the final files of the design.
The client is not allowed to use the final design or any intermediate designs before the full balance is paid.
CANCELLATION
Cancellation of an order can be initiated from the client's side at any point and for any reason. The 50% deposit is non-refundable, however, the remaining 50% is not paid by the customer if the final design is not approved by the client. If the client is not satisfied with the final design and wants more alterations than included in the price, the further work is subject to additional fees.
NUMBER OF DRAFTS AND ALTERATIONS
For cover art, we allow up to 3 initial sketches to approve the concept. For additional initial sketches, we charge an extra fee estimated individually. Once the sketch is approved, we start the implementation process. Once the artwork is finished (or in the process), we allow up to 3 revision rounds of small alteration that can be implemented within one hour of our designer’s time.
For logo design, we allow up to 3 drafts for approving the style of the logo. Once one of them is approved as final, we can do up to 3 rounds of small alterations that can be implemented within one hour of our designer’s time.
For shirt design, we allow up to 3 initial sketches to approve the concept. For additional initial sketches, we charge an extra fee estimated individually. Once the sketch is approved, we start the implementation process. Once the artwork is finished (or in the process), we allow up to 3 revision rounds of small alterations that can be implemented within one hour of our designer’s time.
FILE FORMATS
The final file with album art is provided in JPG format in high resolution (in most cases, 3000x3000 pixels). On request, we can also send it to you in a format adapted for printing (for example PDF or TIFF). The final file with a logo/emblem is provided in vector EPS format and in raster PNG format on a transparent background. The final file with a shirt design is provided in vector EPS or AI format.
PROJECT FILES AND SOURCE FILES
We do not provide Photoshop project files with the artwork in layers unless agreed in advance. As an exception, we can provide you with a PSD file where the album art and logo/title are made in separate layers, so you can change their position in the future. We do not provide files with any source materials used in the process of designing.
COPYRIGHT
The client receives exclusive rights, including rights for commercial use, to the artwork designed by the All4band Design team on his/her behalf. All4band Design and their designers retain rights to utilize artwork and all design elements for portfolio/self-promotion as well as displaying it at presentations, workshops, galleries. We never provide commissioned artworks to third parties OR use them for commercial purposes.
LICENSING OF PRE-MADE DESIGNS
All pre-made designs are offered for licensing with exclusive rights, including rights for commercial use. Each design can be licensed by one client only. All4band Design and their designers retain rights to utilize artwork for portfolio/self-promotion.
DESIGN CREDITS
You are not obligated to credit the artist OR our studio, but it’s always very appreciated. We prefer our designs to be credited as “Designed by Artist Name at All4band Design”. We will always share the name of the artist who worked on your specific project upon request. Or you can simply credit our studio All4band Design.
SUB-CONTRACTORS
All4band Design reserves the right to use services of sub-contractors and third-party designers when it helps to achieve the goals of the project without increasing the budget.
ACCEPTANCE OF TERMS AND CONDITIONS AND QUOTATION
By placing an order and paying a deposit for design and/or any other services offered by All4band Design, by email, verbally or in writing, you express your acceptance of these terms and conditions.
